Probate Services

We are licenced by the Institute of Chartered Accountants in England & Wales to carry out the reserved legal activity of non-contentious probate services. This is an ancillary service that we provide to our existing clients.

We have professional indemnity insurance in place in accordance with ICAEW regulations. Our professional indemnity insurance cover is up to a maximum of £3,000,000 and is capped at this level

ICAEW PROBATE COMPENSATION SCHEME

In the unlikely event that we cannot meet our liabilities to you, you may be able to seek a grant from ICAEW’s Probate Compensation Scheme. Generally, applications for a grant must be made to ICAEW within 12 months of the time you became aware, or reasonably ought to have become aware, of the loss.

Complaints Procedure

If you would like to talk to us about how we could improve our service to you, or if you are unhappy with the service you are receiving, please let us know by contacting Wayne Goddard, the Head of Legal Practice.

We will consider carefully any complaint you may make about our probate or estate administration work as soon as we receive it and do all we can to resolve it. We will acknowledge your letter within five business days of its receipt and endeavour to deal with it within eight weeks. If we do not deal with your complaint in this time, or if you are unhappy with our response, you may of course take up the matter with the Legal Ombudsman

The Legal Ombudsman’s ability to deal with your complaint is dependent on the following factors;

  • you must refer the complaint to the Legal Ombudsman no later than; Six years from the act/omission; or three years from when you should reasonably have known there was cause for complaint; and
  • You must refer the complaint to the Legal Ombudsman within six months of the date of our written response.

Description of Services

The services we offer include:

  • Send notifications of death to the relevant government organisations, financial institutions, utility providers
  • Identify any entitlement to bereavement allowances or benefits
  • Finalise the income tax and capital gains tax position of the deceased for the tax year
  • Ensure the validity of the will, codicils and legacies
  • Prepare any necessary affidavits
  • Identify the beneficiaries based on the provided information
  • To advise whether a grant is required
  • Obtain a valuation of the estate
  • Prepare the inheritance tax return
  • Prepare the application for a grant of probate/grant of administration
  • Place statutory notices in The Gazette and local newspapers
  • Prepare and take any appropriate oaths
  • Obtain the grant
  • Take control and gather the assets of the estate
  • Pay debts of the estate, including tax liabilities
  • Finalise the estate tax
  • Pay any legacies
  • Transfer the remaining balance to the residuary beneficiaries; and
  • Prepare the estate accounts

The key stages of our probate service are:

  • An initial meeting with the Executor to establish the size and complexity of the Estate.
  • Summarise the assets and liabilities of the Estate to determine whether IHT is payable.
  • Obtain professional valuations and third-party confirmations of assets.
  • Submit IHT forms, if required.
  • Prepare the application for Grant of Probate.

Timescale:

  • We will provide an initial estimate of how long the engagement is expected to take and the cost. The time and costs to complete an engagement such as this can vary depending on the complexity of the Estate and the Will.
  • We will keep you informed of progress as work progresses.
  • Typically, a straight forward Probate application can take in the region of 6-9 months up to the time of submission to the Probate Office.

Our fees may depend, not only upon the time spent on your affairs, but also on the level of skill and responsibility and the importance and value of the advice we provide, as well as the level of risk.

If we provide you with an estimate of our fees for any specific work, the estimate will not be contractually binding unless we explicitly state that will be the case. Otherwise, our fees will be calculated on the basis of the hours worked by each member of staff necessarily engaged on your affairs, multiplied by their charge-out rate per hour, VAT being charged thereon. Indicative hourly charge-out rates are as follows:
